Whilst the greatest effort has been made to ensure the quality of this text, due to the historical nature of this content, in some rare cases there may be minor issues with legibility. The fifth edition of this book, which was published in January, 1903, is already exhausted. Since its appearance, new Rules of the Supreme Court have been published, and many important points have been decided, which affect the procedure of our Courts. This has involved considerable modification in the present edition. The chapter on Costs has been re-written. All relevant decisions have been noted down to and including August 1st, 1906; and the whole book has been thoroughly revised and brought up to date.

I have to thank my friend, Mr. Clement C. Gatley, of the Inner Temple, and my son, Mr. Walter Blake Odgers, of the Middle Temple, for the efficient assistance which they have rendered me in the preparation of this edition and in passing it through the press.
